General Terms and Conditions of Molinari Group GmbH – GTC

1. Scope of Application

These General Terms and Conditions ("GTC") apply to Molinari Group GmbH (hereinafter "Company"). They govern the relationship between Molinari Group GmbH and the customer.

 

2. Conclusion of Contract

Upon conclusion of the contract, the customer receives confirmation from the Company regarding the purchase of products. The presentation of goods on the website does not constitute a legally binding offer, but merely a product presentation.

 

3. Prices All prices are in Swiss francs (CHF) and are shown excluding value added tax (VAT). Any other applicable taxes will be charged separately. Packaging and shipping costs are not included. A flat rate of CHF 14.50 per shipment applies. For deliveries of fresh meat, a flat rate of CHF 14.50 is charged. The company reserves the right to adjust prices at any time. The prices valid at the time of order placement apply. Weight specifications may vary (± 20g). The average weight is always published on the website.

 

4. Payment The company requires that orders be paid using the provided payment methods. The company reserves the right to refuse delivery or service in the event of late payment.

 

5. Delivery / Delivery Times

Orders are processed within 72 hours and then forwarded to the selected delivery service (excluding Sundays and public holidays). If timely delivery is not possible, the customer will be contacted after the order is received. To maintain the cold chain, delivery of fresh products is only possible within the region specified in the predefined delivery area. The legally mandated maximum temperatures can only be maintained by the company if the customer accepts the delivery immediately. The company is entitled to make partial deliveries, provided this is reasonable for the customer. If a partial delivery is due to our fault, the customer will not be charged shipping costs separately; the costs remain as stated in the total delivery.

 

6. Exchanges & Returns

For reasons of meat hygiene, any exchange of fresh meat products is generally excluded. In the case of incorrect deliveries or quality complaints, we will gladly exchange the item in question. Please always include your customer number, invoice number, and the reason for the return. Returns are at your own risk and expense.

7. Warranty

The statutory warranty provisions apply. Any defects must be reported to the company immediately. The company reserves the right to decide whether the defective product will be replaced. The customer is only entitled to a reduction or refund of the purchase price if a replacement is not possible and the product has been classified as defective by Molinari Group GmbH.

8. Liability

Any liability for indirect damages and consequential damages is excluded. In the case of direct damages, liability is limited to the contract price, except in cases of gross negligence or intent. The customer is obligated to report any damages to the company immediately.

 

9. Intellectual Property

Rights The company reserves all rights to the products, services, and any trademarks and their use. The further use, publication, and making available of information, images, texts, or other materials that the customer receives in connection with these provisions is prohibited unless explicitly authorized by the company. If the customer uses content, text, or images in connection with the company that are subject to third-party intellectual property rights, the customer must ensure that no third-party rights are infringed.

 

10. Data Protection

The company may process and use the data collected during the conclusion of the contract to fulfill its obligations. Detailed data protection provisions can be viewed at molinarisempione.ch/datenschutzerklaerung/.

 

11. Amendments

The company reserves the right to amend these General Terms and Conditions at any time. The most recent provisions always apply. This does not apply to customers for whom the older version of the General Terms and Conditions was in effect at the time of contract conclusion. Customers who concluded their contract with an older version may agree to a newer version.

 

12. Severability Clause

Should any provision of this contract or any appendix to this contract be or become invalid, the validity of the remaining provisions shall not be affected. The contracting parties will replace any invalid provision with a valid provision that most closely approximates the intended economic purpose of the invalid provision. The same applies to any gaps in the contract.

 

13. Confidentiality

Both parties undertake to treat all information relating to the services provided as confidential. This obligation shall remain in effect even after the termination of the contract.

14. Force Majeure (Vis Major)

The company, its suppliers, or any third parties engaged by it are released from their obligations to perform on time should this occur as a result of force majeure, such as natural disasters, wars, civil unrest, or strikes. If the force majeure lasts longer than 30 days, the company may withdraw from the contract. In this case, the company will fully reimburse the customer for any payments already made. Any further claims, in particular claims for damages resulting from force majeure, are excluded.

 

15. Applicable Law / Jurisdiction

These General Terms and Conditions are governed exclusively by Swiss law, and the place of jurisdiction is Brig.
